1. Agreement to Terms
These Terms of Service (the "Terms") constitute a legally binding agreement between you ("User," "you," or "your") and 1001478120 Ontario Inc., operating as "RentHomie" ("Platform," "we," "us," or "our"). "RentHomie" is the operating name of 1001478120 Ontario Inc., and both refer to the same entity throughout these Terms and our other policies. By accessing, registering for, downloading, or using the RentHomie website or mobile application (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms.
Beta Services Disclaimer: If you are using a Beta version of the Services ("Beta Services"), you acknowledge that the Services are currently in a preliminary development stage. The Beta Services may contain bugs, errors, or inaccuracies. RentHomie provides Beta Services "AS IS" without warranty of any kind. You agree that your participation in the Beta program is voluntary and does not create a legal partnership, agency, or employment relationship.
If you do not agree to these Terms, you must not access or use the Services.
2. Description of Services
RentHomie is a platform designed to facilitate property management by connecting Landlords, Tenants, Property Managers, and Contractors. Our Services include, but are not limited to:
- Listing and managing rental properties.
- Creation and signing of rental agreements, and tenant invitations.
- Maintenance request tracking and AI-backed triage.
- Facilitation of communication between parties via chat.
- Payment processing for rent, deposits, and maintenance services.
- Rent collection, including automated pre-authorized bank debits, where enabled.
- Optional third-party property management engagements.
RentHomie acts as a platform provider. While we provide tools for triage and dispute resolution, we are not a real estate broker, insurer, or general contractor. We do not employ the Contractors listed on our Services, nor do we own the properties listed by Landlords.
3. User Accounts and Eligibility
To use the Services, you must be at least 18 years old (or the age of majority in your province or territory) and capable of forming a binding contract. You agree to:
- Provide accurate, current, and complete account information.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Notify us immediately if you discover any security breaches.
Users may act in different capacities (e.g., as a Landlord, Tenant, Property Manager, or Contractor), and may hold more than one role from a single account. You are responsible for ensuring your activities comply with all applicable laws, including residential tenancy legislation, fair housing and human rights laws, and contractor licensing requirements in your jurisdiction.
4. AI Triage and Diagnostics
A core feature of RentHomie is our AI-backed triage system, which assists in diagnosing maintenance issues. You acknowledge and agree that:
- Information Purposes Only: The AI diagnosis is for informational purposes to streamline the quoting and repair process. It does not constitute a professional engineering inspection or a definitive guarantee of the problem's root cause.
- Not Professional Advice: RentHomie is not liable for actions taken based on AI recommendations (e.g., DIY determinations). Users assume all risks associated with performing self-repairs.
- Data Usage Consent: By using the maintenance and triage features, you explicitly grant RentHomie the right to use submitted data (text descriptions, media, diagnostic outcomes) to train, refine, and enhance our machine learning models to improve user experience.
- Onsite General Triage Technicians: RentHomie may dispatch general triage/diagnostic contractors to perform limited onsite diagnostics or assist with simple, non-licensed tasks (e.g., basic troubleshooting, resets, visual inspections). These technicians are not engaged to perform licensed professional services and will not alter, install, repair, or modify systems requiring permits or specialized licensing (including but not limited to electrical, plumbing, HVAC, and structural work).
- No Licensed Work by Triage Technicians: Any work requiring a license or permit must be performed by a duly licensed professional contractor selected through the platform’s work order process. Onsite triage technicians are strictly limited to preliminary assessment and basic non-licensed support.
- Safety and Scope Limitations: You acknowledge that onsite triage is inherently limited and not a substitute for professional services. RentHomie and its triage technicians may recommend escalation to licensed contractors when appropriate. You agree to follow safety guidance and not request or authorize triage technicians to perform licensed work.
5. User Content and Conduct
You retain ownership of the content you upload (e.g., property photos, chat messages). However, by uploading content, you grant RentHomie a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and modify such content for the purpose of operating, developing, providing, and improving the Services.
You agree not to engage in prohibited conduct, including but not limited to:
- Posting false, misleading, or fraudulent content.
- Harassing, threatening, or discriminating against other users.
- Attempting to bypass our payment system to avoid fees ("off-platforming").
- Uploading viruses or malicious code.
6. Payment Terms
Payment processing services on RentHomie are provided by Stripe. By using our payment features, you agree to the Stripe Connected Account Agreement. Certain rent collection features rely on pre-authorized debit (EFT) and Interac payment methods, and by enabling them you authorize the corresponding debits from your designated account.
- Escrow: Payments for maintenance work may be held in escrow (deposit) until work is completed or approved.
- Authorizations: You authorize us to charge your registered payment method for all fees incurred, including rent, service fees, and maintenance costs.
- Subscriptions: Paid plans are billed on a per-property basis according to the plan you select, on a recurring basis until cancelled.
- Failed Payments: Rent debits that are returned or fail (e.g., non-sufficient funds) may be subject to retry, cure periods, and applicable fees.
- Refunds: Refunds are handled according to our cancellation policies, which vary based on the stage of the work order (e.g., pre-deposit vs. post-scheduling).
7. Third-Party Service Providers
We rely on third-party service providers to operate and deliver the Services, including Stripe, Supabase, Google, Firebase, Zūm Rails, and Vercel. Your use of the Services may be subject to those providers’ own terms and policies. We are not responsible for the acts or omissions of third-party providers.
8. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." RENTHOMIE DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS.
RENTHOMIE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF RENTHOMIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
9. Indemnification
You agree to indemnify and hold RentHomie and its officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including legal fees) arising out of or in connection with: (i) your use of the Services; (ii) your breach of these Terms; (iii) RentHomie's use of your User Content; or (iv) your violation of the rights of any third party, including Contractors or Tenants.
10. Dispute Resolution
We encourage you to contact us first to resolve any concerns. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally will be handled in accordance with the laws and courts identified in Section 11, subject to your rights under applicable consumer-protection and residential-tenancy legislation, which are not waived by these Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. You agree to the exclusive jurisdiction of the courts located in the Province of Ontario for any dispute not otherwise subject to a binding dispute-resolution process.
